TERMS & CONDITIONS OF BOOKING & STAYS
OCCUPANCY
Guest agrees that no more than the agreed number of persons shall be permitted on the property at any time during the rental term, all of whom shall comply with the conditions and restrictions imposed upon the guest under the agreement.
The lead guest must provide their home address and government-issued photo ID in digital format. The full names and contact details for each adult guest (18 and over) staying are also required.
Guests agree that the booking is for a short-term stay for leisure, business, or temporary purposes as defined by the Housing Act 1988 Schedule 1 paragraph 9. Guests cannot claim the property as their primary residence. It cannot be construed as an assured tenancy under The Housing Act 1988 (as amended) or lease and is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977. All our guests have a licence to occupy; it does not create an assured tenancy or lease.

CONDITION AND USE OF PROPERTY
The property is provided in “as-is” condition. The rental agent will make every effort to ensure amenities (such as internet access and smart TV) are functional, but will not be liable for any amenity failure. Reported issues will be addressed promptly.
For longer-term bookings, our hospitality team will visit to clean, change linens, and inspect the property. Guests agree to allow all Moneypenny Homes Ltd representatives including our hospitality and maintenance teams access at any time.
The property is to be used only for residential purposes. Guests and permitted guests shall keep noise levels low between 9:00pm and 9:00am, especially in family residential areas. Parties or large gatherings are prohibited.  All neighbours are aware of our procedures should there be any disturbance, and that all our guests are required to respect our neighbours.
The property must be used lawfully, and guests shall not disturb, endanger, or inconvenience neighbours. Guests are expected to leave the property clean and in good condition.
Guests can only stay for the period they have paid for which will be charged on a daily basis.

DEFAULT
If guest should fail to comply with the conditions and obligations of this agreement, guest shall surrender the property, remove all guest’s property and belongings and leave the property in good order and free of damage. No refund of any portion of the total rental fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

ASSIGNMENT OR SUBLEASE
Guests shall not assign or sublease the property or permit the use of any portion of the property by other persons who are not family members of guests of the guest and included within the number of and as permitted occupants of this agreement. No one not listed on the booking is allowed to occupy the property at any time.

RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, furnishings, personal affects, vehicles and other items brought into the property by guest or their permitted guests and visitors shall be at the sole risk of guest with regard to any theft, damage, destruction or other loss and rental agent shall not be responsible or liable for any reason whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless rental agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by guest, permitted guests, visitors or agents, representatives or successors of guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by guest or family and visitors of guest in or about the property and guest expressly agrees to save and hold rental agent harmless in all such cases.

RELEASE OF LIABILITY
Guest hereby waives and releases any claims against rental agent, the property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by guest on or near or adjacent to the property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the guest’s own initiative, risk and responsibility.

ENTRY AND INSPECTION
The rental agent reserves the right to enter the property at any time for any reason to include inspections, maintenance, or showing to prospective renters or buyers. 

UNAVAILABILITY OF PROPERTY
In the event the property is not available for use during the rental term due to reasons, events or circumstances beyond the control of rental agent, rental agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the guest. If such replacement property cannot be found and made available, rental agent shall immediately return all payments made by the guest, whereupon this agreement shall be terminated and guest and rental agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

ADDITIONAL TERMS TO THE RENTAL POLICY
In addition to the standard terms included herein, guest acknowledges and agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:
1.1 You must be 25 years or over when you book your accommodation. Your booking is made as a consumer and you acknowledge that no liability can be accepted for any losses suffered or incurred by you.
1.2 We reserve the right to refuse to accept any booking for whatever reason.
1.3 Guests may check in after 3:00pm (unless otherwise specified/agreed) and must vacate by10:00 am (unless otherwise specified/agreed) on the last day of the booking. If guests fail to arrive by midnight on the day of the start date and fail to advise us that they intend on arriving late or that they are delayed, we may treat the booking as being cancelled by you without refund.
1.4 If the number of people permitted to occupy an apartment is exceeded (which would be in breach of Health and Safety Regulations) we reserve the right to charge £30 for each extra person, move excess occupants and charge for additional apartments or require the excess occupants to vacate the property.
1.5 The total price for your entire stay will be presented to you before you confirm your booking. Full payment is required to make a booking unless expressly agreed otherwise by the rental agent. This can be made by credit or debit card. Please be aware that pricing is dynamic and therefore the price for the same or similar accommodation may vary over time after your booking is made. Should the payment not reach us within the required time we reserve the right to cancel any bookings made and any deposit will be forfeit.
1.6   A bank transfer or card details for a £200 deposit to cover replacing or repairing damages and breakages and damages are required. These may include furniture, upholstery, fittings, appliances or other fixtures and items damaged during your stay. These can be charged up to two (2) working days after the guests stayed in the property, or if for any reason we can’t apply a charge against your credit/debit card then a fully itemised invoice detailing a break down of costs will be sent to you which you agree to pay within 14 days of receipt. Charges are only applied provided the following provisions are not met:
  • No damage is done to property or its contents including fire alarms.
  • No charges are incurred due to illegal activity, unauthorised pets or additional services rendered during the stay.
  • All debris, rubbish and discards are placed in recycling or rubbish bin, and soiled dishes are cleaned.
  • All keys are left in the key safe (or same place as the guest collected them from) or as otherwise instructed and the accommodation is left locked.
  • All charges accrued during the stay are paid prior to departure.
  • No contents or linens are lost or damaged.
  • No early arrival or late departure.
  • No smoking within the apartment.
  • The renter is not evicted by the owner (or representative of the owner) or the local law enforcement.
1.7 We expect the apartment to be left in a reasonable state on departure. If, at our discretion, additional cleaning is required on departure, the cost of this cleaning will be charged as an additional charge.
1.8 Where there is evidence of guests smoking or vaping within the apartment, we reserve the right to charge £200 for specialist cleaning.
1.9 Only authorised pets are permitted in our rental units. Additional pet fees will applied.
2.0 If cancelled or modified up to 30 days before date of arrival, no fee will be charged except if it is stated any different at the time of booking. If cancelled or modified later or in case of no-show, the total price of the reservation will be charged.
2.1 Unless otherwise agreed, the owners will issue to the client or guest one set of keys to the property. If at any time the client or guest loses the keys, they must notify us as soon as possible and we will instruct a locksmith to change the lock/key(s) and charge the client or guest. Lockout callout fees may also apply.
2.2 Closed Circuit TV (CCTV) cameras or web cameras in the form of video doorbells or network cameras are installed in entrance ways of all of our properties. These are fitted for the safety and security of all our guests and premises. Guests are not permitted to switch off, disconnect, cover or otherwise interfere with or disable these devices. Any attempt to do so is considered a breach of the agreed terms and conditions and guests will be asked to reinstate or otherwise may be asked to leave the property with no refund of any portion of the rental fee. Your deposit may also be charged.
2.3 A Minut monitor is installed on the property to measure noise levels, occupancy, and temperature for safety and compliance purposes. This device does not record conversations or capture personal data. Tampering with or disabling the monitor is strictly prohibited and may result in immediate termination of the booking and forfeiture of the deposit.
2.4 Recycling boxes/bags must be used for all recyclable items as per the signage in the property. If recycling is found in the general waste bin you may be charged for additional waste collections.

PAYMENTS, CANCELLATION, AND MODIFICATIONS
Full payment is required to confirm a booking, unless expressly agreed otherwise. Pricing is dynamic, and the quoted price is only guaranteed upon booking. Payment methods include credit or debit card.
If cancelled or modified up to 30 days before arrival, no fee will apply. Cancellations made within 30 days or no-shows will be charged the full reservation amount.

GENERAL PROVISIONS
This agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the guest and the rental agent.
This Agreement shall be governed by the laws of the United Kingdom. The words “rental agent” and “guest” shall include their respective heirs, successors, representatives.
The waiver or failure to enforce any breach or provision of this agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the agreement shall not be affected. 
Any notice required to be given under this agreement shall be in writing and sent to the contact information included herein. This agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.
